Terms of service

Welcome to Loyalisto ("Platform", "we", "us", "our"). Loyalisto is a multi-tenant digital loyalty card platform that enables merchants ("Merchants") to create and manage loyalty programmes for their customers ("End Users"). By accessing or using our services at loyalisto.com, you agree to these Terms of Service.

Loyalisto provides:

• Digital loyalty card creation and management for Merchants
• Apple Wallet and Google Wallet integration for End Users
• QR code scanning and stamp or points tracking
• Push notifications via Google Wallet
• Customer analytics and campaign management
• API access for POS and third-party integrations, on the plans that include it. The pricing page states which plan each capability belongs to

Merchants must provide accurate business information when registering. Each Merchant receives a branded subdomain, for example yourshop.loyalisto.com, and is responsible for the content of their loyalty programmes, including rewards, messaging, and compliance with local laws.

End Users join loyalty programmes voluntarily by scanning a QR code and adding a loyalty card to their digital wallet. No account or password is required. End Users may opt in to messages on the card itself and to email. Loyalisto does not send text messages. All communication preferences can be managed from the self-service preference page linked from each loyalty card.

Loyalisto complies with the General Data Protection Regulation (GDPR). We act as a Data Processor on behalf of Merchants, who are the Data Controllers. End Users have the right to:

• Access their data via the preference page
• Modify their notification preferences at any time
• Request complete data erasure, the right to be forgotten
• Opt out of all communications with a single action

All consent actions are logged with timestamps, IP addresses and consent text versions for auditability. Our privacy policy and GDPR page set this out in full.

Loyalisto offers tiered subscription plans. Payments are processed by a PCI-compliant payment processor on our behalf: we never see or store full card details. Merchants may upgrade, downgrade or cancel at any time.

Every plan includes a monthly allowance of wallet messages, listed for each plan on the pricing page. Notification credits can be bought as a one-off pack on top of that allowance. They are drawn on only once the month's allowance is spent, they carry over between months, and they are non-refundable once used.

You agree not to use Loyalisto to:

• Send unsolicited or spam messages to End Users
• Collect or store sensitive personal data beyond what is necessary
• Engage in fraudulent or deceptive loyalty programmes
• Violate any applicable laws or regulations

Loyalisto is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental or consequential damages arising from the use of our platform. Our total liability is limited to the fees paid by the Merchant in the 12 months preceding the claim.

Either party may terminate at any time. Upon termination, Merchant data will be retained for 30 days before deletion. End User data will be anonymised in accordance with GDPR requirements.
